Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Michael Lewellen, sole proprietor doing business as DeepFind Hunter ("DeepFind Hunter," "we," "us"), governing your use of the DeepFind Hunter mobile application and the deepfindhunter.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You are responsible for all activity under your account. You may permanently delete your account and data at any time from Settings → Account → Delete Account in the App; see our account-deletion instructions.

2. Description of Service

DeepFind Hunter is a companion app for metal detecting hobbyists, offering an interactive treasure map with public-domain USGS terrain layers, GPS hunt-session recording, a personal Find Log, a Hunt Coach, an AI LiDAR Analysis research tool, and community posts.

The Service is currently in closed beta and is provided as unfinished software. Features labeled "Beta" may be incomplete, may depend on a third-party provider or pending real-device validation, and may report themselves unavailable rather than returning a result. Features marked "Coming Soon" are not included in the current Android beta. We make no commitment that any Beta or Coming Soon feature will become generally available, and we publish no release dates.

3. AI Features — Important Disclaimer

The Hunt Coach and AI LiDAR Analysis features are research and guidance aids only. Every feature identified by AI LiDAR Analysis is labeled "possible" or "suspected" and requires field verification — it is never a confirmed discovery, and DeepFind Hunter makes no guarantee about the presence, nature, or value of anything at a mapped location. AI-generated suggestions are not professional, legal, archaeological, or safety advice. You are solely responsible for verifying land ownership, obtaining permission, and complying with all applicable laws, permits, and site-specific regulations (including historic-preservation and cultural-resource laws) before searching or digging anywhere.

4. Location-Based & Safety Disclaimer

Metal detecting, including night detecting and detecting near or in water, carries inherent risks (terrain hazards, tides, wildlife, traffic, trespass). You use location-based features and act on any information from the Service entirely at your own risk. GPS and mapping data may be inaccurate or incomplete; always verify conditions in person and follow local laws and posted signage.

5. Subscriptions & Payments

Subscription plans are billed through the Apple App Store or Google Play Billing (validated via RevenueCat). We do not sell subscriptions through the website and there is no web checkout. Subscriptions renew automatically until canceled; manage or cancel your subscription through your App Store or Google Play account settings, not in the App. Refunds are handled according to the applicable store's refund policy; we do not directly process App Store or Play Store refunds.

The current plans are Free at no cost and Pro at $9.99 per month or $79.99 per year, including a one-time 30-day Pro trial. Because the Service is in closed beta with no public store listing, no subscription is on sale at this time. Prices may change; we will give notice of a change affecting an active subscription as required by the applicable store and by law.

6. Marketplace Terms

Marketplace: Coming Soon — not included in the current Android beta. If a future version enables Marketplace, it may let users list detecting-related items and message one another. Sellers would be required to complete Stripe Connect Express onboarding, including identity verification performed directly by Stripe. DeepFind Hunter would host listings and facilitate payment, but would not be a party to, or guarantee, authenticate, or appraise, any sale or item between buyer and seller. Sellers would be responsible for accurately describing items, complying with shipping/export laws, and resolving disputes with the other party. Prohibited items would include anything illegal to sell, hazardous materials, and any culturally protected or stolen artifacts. Any platform fee would be disclosed at checkout.

7. Community Content & Conduct

You retain ownership of content you post (find photos, posts, and comments), but you grant DeepFind Hunter a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the Service. If Marketplace becomes available, this license would also apply to listings. You agree not to post content that is illegal, infringing, harassing, or that reveals another person's private location or personal information without consent. We may remove content or suspend accounts that violate these Terms, and moderators may review reported content.

8. Intellectual Property

The DeepFind Hunter app, branding, and original content are owned by Michael Lewellen / DeepFind Hunter. Map/terrain data is sourced from the public-domain USGS 3D Elevation Program and, as a fallback, Esri World Hillshade under Esri's terms — see the in-app Data Sources & Attributions screen and our Data Sources page for full attribution.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and delete your account at any time.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy or completeness of map, LiDAR, or AI-generated data.

11. Limitation of Liability

To the maximum extent permitted by law, DeepFind Hunter and Michael Lewellen shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss, injury, or dispute arising from your use of location-based features or AI-generated suggestions. This limitation would also apply to marketplace transactions if Marketplace becomes available.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles.

13. Changes to These Terms

We may update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
